This Kinda Pisses Me Off

I read throuh the local paper everyday online to see whats happening. After checking a couple more sites, he wasn't charged with the hit and run, and on top of that, his bail was a friggin' joke, $500 for DUI, open container, failing to yeild to an emergency vehicle and no liscense, which means his insurance was void as well.

I had a simple DUI, no other charges, and the trooper even testified that I blew high, a .11, then on my second time once we got to the courthouse I blew a .02,, which the legal limit is .10, back then. I just blew high because I had just downed a couple, not because I was actually drunk. I had drank 2 beers quick when I had got home and just opened the third and saw I didn't have any smokes, so I ran to the store before I drank anymore and got drunk. My bail alone was 2 grand! Fines around $5000 and another couple of grand on a lawyer, which didn't help anything, and at least another grand on classes and court referal.

Another thing I noticed, it's suppossed to be law you spend no less than 12 hours, or until you can blow all zeros on the breath-a-nator, before you can be released. I had to spend the night in the drunk tank as the only sober bastard in there. They arrested him yesterday, and bonded him out within' a couple of hours.


Guess it pays to be a senator.

Yeah, got one of those in my past, too. Except I took out a fire hydrant -- imagine a column of water, 8" in diameter, shooting 30' in the air, and me, soaking wet trying to get my car unstuck so I can drive home. Blew a .25 and got a free ride home.

I got a break, though. Didn't have an attorney (wasn't going to fight it because I knew I was guilty and deserved whatever I got) but I did have a judge who, inconspicuously, acted on my behalf. DA agreed to reduce to DWAI rather than DUI. Still, took 10 years for the consequences to work themselves out

Lesson learned: NEVER AGAIN!

Only thing I could think of was Driving While Alcohol Impaired, but DUI would be the same thing. Driving Under The Influence, which covers drugs and alcohol.

What's a DWAI ?

DWI = Driving While Intoxicated (same thing as DUI). BAC .08 or higher.
DWAI = Driving While Ability Impaired. BAC .03 - .08.

DWI is a class A misdemeanor in NY for the first offense. Second offense in 10 years is a felony.
DWAI is a traffic violation.

Even though DWAI is, technically, a much lesser offense it will still screw up your life. I lost my license for 6 months and had to attend 3 months of classes in NY's Drinking Driver program. It stayed on my traffic record for 10 years and seriously hindered my ability to get insurance. As I said previously, NEVER AGAIN! Thank God, that was a loooonnng time ago.

I've only been guilty of PWI.....Posting While Intoxicated! Got charged with a 10 day, then a month suspension. LOL

We just have DUI's here. .08 or over or officers discretion. Sounds like the same fines, other than you have to get 4 in your lifetime to get a felony.
