    A 14-year-old Travis County girl who said she was sexually assaulted by a Buda man she met on MySpace.com sued the popular social networking site Monday for $30 million, claiming that it fails to protect minors from adult sexual predators.

    The lawsuit claims that the Web site does not require users to verify their age and calls the security measures aimed at preventing strangers from contacting users younger than 16 "utterly ineffective."

    "MySpace is more concerned about making money than protecting children online," said Adam Loewy, who is representing the girl and her mother in the lawsuit against MySpace, parent company News Corp. and Pete Solis, the 19-year-old accused of sexually assaulting the girl.

    Hemanshu Nigam, the chief security officer for MySpace.com, said in a written statement: "We take aggressive measures to protect our members. We encourage everyone on the Internet to engage in smart web practices and have open family dialogue about how to apply offline lessons in the online world."

    Founded in 2003, MySpace has more than 80 million registered users worldwide and is the world's third most-viewed Web site, according to the lawsuit.

    Loewy said the lawsuit is the first of its kind in the nation against MySpace.

    Solis contacted the girl through her MySpace Web site in April, telling her that he was a high school senior who played on the football team, according to the lawsuit.

    In May, after a series of e-mails and phone calls, he picked her up at school, took her out to eat and to a movie, then drove her to an apartment complex parking lot in South Austin, where he sexually assaulted her, police said. He was arrested May 19.

    The lawsuit includes news reports of other assault cases in which girls were contacted through MySpace. They include a 22-year-old Wisconsin man charged with six counts of sexually assaulting a 14-year-old girl and a 27-year-old Connecticut man accused of sexually assaulting a 13-year-old girl.

    MySpace says on a "Tips for Parents" page that users must be 14 or older. The Web site does nothing to verify the age of the user, such as requiring a driver's license or credit card number, Loewy said.

    To create an account, a MySpace user must list a name, an e-mail address, sex, country and date of birth.

    "None of this has to be true," the lawsuit said.

    Attorneys general from five states, including Texas, have asked MySpace.com to provide more security, the lawsuit said. Texas Attorney General Greg Abbott sent a letter to the MySpace.com chief executive officer May 22, asking him to require users to verify their age and identity with a credit card or verified e-mail account.

    Lauren Gelman, associate director of the Center for Internet and Society at Stanford Law School, said she does not think MySpace is legally responsible for what happens away from its site.

    "If you interact on MySpace, you are safe, but if a 13-year-old or 14-year-old goes out in person and meets someone she doesn't know, that is always an unsafe endeavor," Gelman said. "We need to teach our kids to be wary of strangers."

    Loewy said he was confident about the lawsuit, which he said seeks damages worth 1 percent of the company's estimated worth.

    "We feel that 1 percent of that is the bare minimum that they should compensate the girl for their failure to protect her online when they knew sexual predators were on that site," he said.

    I'm sorry, but people need to learn smoking kills you, eating maccas makes you fat, and getting in a car with a 20 year old stranger when 13 isn't the smartest thing. Be responsible for yourself, stop trying to get a quick buck. grow up society.

    Why be a parent when you can just let your kid run wild, then sue the pants off whatever company is responsible for something stupid your kid does. We live in a litigous society, that replaces lawsuits with parenting. And they always win, at least getting some sort of settlement.

    MYSPACE should counter-sue the parents for even attempting to proceed with this lawsuit.

    Bogus! No, dont want to see anyone get hurt, but lets not be stupid enough to just accept that you are getting 100% truth from someone who is completely anonymous.
    Ive not been on myspace yet, but from what I hear, there are alot of young girls that advertise pretty freely too. Shame. This makes it a predators marketplace.

    This all seems to be a slippery slope. If the girl contacts someone over AOL instant messenger, do you sue AOL? If she calls someone on the phone, do you sue Cingular, Sprint, Verizon, etc ....? Not all parents are aware of the dangers of online sites, and I can't necessarily blame them for that (being that they are not necessarily from a computer generation). But I hope their kids would know that it probably isn't the best idea to post half naked pictures of themselves online for the world to see.

    Hopefully soon we will see less and less of this as parents are brought up in a generation that grew up with computers.

    Parents should be aware of what the heck their children are doing. If I have a daughter, she's not going on a "date" when she's 14, and DEFINITELY NOT with a random stranger from online. There's a point where individuals need to start blaming themselves rather than pointing the finger at someone else. It isn't MySpace's job to babysit your kid, it's your job mom and dad, so get your act together.

    I don't see this as being MySpace's fault. There are so many other places online where a predator can find and molest underage girls that it's not even funny. And it's still not MySpace's fault because the internet, as such, is mostly public domain. What, are we supposed to make movie theaters also verify the age of those who come in to see movies? There are places offline that those guys took those girls that could have also verified their ages. It's hogwash. I blame the parents for not teaching their kids properly. I blame the predators for, well, doing what they do. I blame the children for not listening to their parents and the millions of other voices in our society telling them not to talk to strangers. I don't think it's MySpace's fault at all. There are still tons of chat rooms where underage children go and there's no way anyone can filter people out by age.

    However, if you want MySpace to start charging for the accounts so that it can pay for the licensing and equipment and access to age verifying mechanisms like credit card and driver's license stuff, go right ahead. It's still going to require that the user on the other end is telling the truth. Teenagers and those underage, and sexual predators, can always steal people's identities to commit crimes. Teenagers can still steal credit cards and driver's licenses from their parents, so the point is still moot. It's the internet. If you don't trust your teen, don't have any internet.

    And if they want to get into the math, hmm let's see:
    Predator: 100% at fault
    Kid: 10% at fault (minimum)
    Parents: 10% at fault (minimum)
    My Space: 1% at fault (according to them)

    Ok, guess the parents and kid should be paying MySpace for it being their fault

    if the law let people to pay beacuese they didn't write "do not dry pets" on a microwave ,it will be the same in this case.
    MySpace or whatever can't do anything for stupid kids and predators.What about icq messenger and whatever.I think the The car company of the predator have to pay too!!!I hate this f*****g stupid "let's make money" mood ,from parents ,who have a abused kid and do nothing more than thinking on money ,and the worse thing ,they don't even get why it happend!!!And the danger is still out there !!!Making money will not change the psychology of their poor girl (i don't know if she is poor ,i know many "kids" here in Germany who have sex with 12 and know what they want)and will not change the sexual predators out there too.And myspace can do nothink for that.i mean what ahppens if a 35 year old woman get raped from a 19 year that she met on myspace!!!???
