Contest Rules

THE FOLLOWING CONTEST SHALL BE GOVERNED BY, CONSTRUED, AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE UNITED STATES. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL CONTEST RULES
Sponsor: Seymour Duncan, 5427 Hollister Ave., Santa Barbara, CA 93111 USA (“Seymour Duncan”).
No Purchase Necessary to Enter or Win: No purchase is necessary to enter or win. Entrants need not be present to win and need not attend, view or hear any sales presentation to enter or win.

Entry: Entrants may enter the contest by fully completing and submitting the entry form at http://www.seymourduncan.com/p-rails. One entry per person. By entering, entrants agree to be bound by these Official Rules and to comply with all federal, state, and local laws and regulations.
Eligibility: This contest is open to entrants 18 years or older as of May 1, 2008. Employees of Seymour Duncan, Seymour Duncan’s international distributors, and its affiliates, their agencies and representatives and their immediate family members, and individuals residing in the same household as such individuals are not eligible to participate in this contest. This contest is void where prohibited by law and is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to these official rules, the decision of Seymour Duncan with respect to this contest as final.

Contest Period, Semi-Finals and Voting: The contest will officially begin on May 1, 2008 and entries will be accepted until 11:59 PM, PDT, on September 1, 2008. The winners will be chosen from all eligible entries received and one winner will be drawn randomly. The potential prize winner will be notified by U.S. mail, email, telephone and/or overnight courier within thirty (30) days after September 15, 2008. If a winner is unreachable for five (5) days after being contacted by Seymour Duncan, or if that winner is otherwise unavailable for prize fulfillment, that potential winner may be disqualified and an alternative winner may be selected by random drawing among all remaining eligible contestants. The winner will be subject to verification and must meet all eligibility requirements before a prize is awarded.
By submitting an entry, you grant to Seymour Duncan and its affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information, submission/entry and written or oral statements, for advertising and promotional purposes in promoting or publicizing Seymour Duncan and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e-mail address, biographical information, or entry. The rights granted under this paragraph shall extend to Seymour Duncan and its affiliated companies with respect to all entrants in the contest, including those entrants who are selected as Winner and those entrants who are not selected as Winner. Seymour Duncan is under no obligation to use the winning entries for any purpose.
Prizes and Odds of Winning: One prize of either of ESP LTD PB-500 electric guitar, MSRP $929. The odds of winning will depend upon the total number of eligible entrants. ALL PRIZES ARE AWARDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLIDNG, WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY OF MERCHANTABILITY.

General Considerations: Prizes will be shipped to the winner at the address provided on the entry form. No substitutions, cash equivalents, or transfers of the prizes are permitted. Prizes will be shipped to winner by Seymour Duncan at no cost. Winner is responsible for the payment of all applicable federal, state and local taxes.
Limitation of Liability: Neither Seymour Duncan nor any of its affiliates is responsible for printing or typographical errors in any contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries; or for transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Seymour Duncan reserves the right to cancel or modify the contest if fraud or technical failures compromise the integrity of the contest, as determined by Seymour Duncan in its sole discretion. By entering, participants release and hold harmless Seymour Duncan and its affiliates and their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity.
